Terms and Conditions: Sailing Instructor Services

  • Scope of Services: The sailing instructor (“Instructor”) will provide sailing instruction services to the client (“Client”) as agreed upon in advance. Services may include practical on-water instruction, theoretical classroom sessions, and any additional services outlined in the agreement.

  • Booking and Payment: Clients must book sailing instruction sessions in advance and pay the agreed-upon fees according to the payment schedule outlined in the agreement. Payment methods and cancellation policies will be specified in the agreement.

  • Client Responsibilities: Clients are responsible for providing accurate information regarding their sailing experience, physical condition, and any relevant medical conditions. Clients must adhere to safety guidelines and instructions provided by the Instructor at all times during instruction sessions.

  • Safety: The safety of the Client and Instructor is of utmost importance. Clients must follow all safety protocols and guidelines established by the Instructor during instruction sessions. The Instructor reserves the right to cancel or reschedule sessions due to inclement weather or unsafe conditions.

  • Liability: The Instructor shall not be liable for any loss, damage, injury, or death resulting from the Client’s actions or negligence during instruction sessions. Clients participate in instruction sessions at their own risk.

  • Insurance: Clients are advised to obtain appropriate insurance coverage, including personal liability insurance, to protect against any unforeseen circumstances or accidents during instruction sessions.

  • Intellectual Property: Any materials, documents, or resources provided by the Instructor during instruction sessions remain the intellectual property of the Instructor and may not be reproduced or distributed without prior consent.

  • Termination of Services: The Instructor reserves the right to terminate services if the Client fails to adhere to the terms and conditions outlined herein or engages in behavior deemed unsafe or inappropriate by the Instructor.

  • Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Texas, and any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Texas.

Terms and Conditions: Sail Charter/Retreat Services

  • Booking and Payment: Clients must book sail charter services in advance and pay the agreed-upon charter fees according to the payment schedule outlined in the agreement. Payment methods, cancellation policies, and any additional fees (e.g., security deposit, fuel surcharge) will be specified in the agreement.

  • Charter Period: The charter period will commence and end at the times specified in the agreement. Clients must adhere to the agreed-upon schedule and return the vessel to the designated location by the agreed-upon time.

  • Use of Vessel: Clients are responsible for using the vessel in a safe and responsible manner, adhering to all maritime laws and regulations, and following the instructions provided by the charter company or vessel owner.

  • Security Deposit: Clients may be required to provide a security deposit prior to the commencement of the charter period. The security deposit will be refunded to the Client upon the safe return of the vessel, less any deductions for damages or losses incurred during the charter period.

  • Insurance: Clients are advised to obtain appropriate insurance coverage, including hull insurance and liability insurance, to protect against any damages, losses, or liabilities incurred during the charter period.

  • Maintenance and Repairs: Clients must report any damages or malfunctions of the vessel to the charter company or vessel owner immediately. The charter company or vessel owner will be responsible for arranging repairs or maintenance as necessary.

  • Safety: The safety of all passengers and crew members is of utmost importance. Clients must follow all safety protocols and guidelines established by the charter company or vessel owner during the charter period.

  • Termination of Charter: The charter company or vessel owner reserves the right to terminate the charter agreement if the Client fails to adhere to the terms and conditions outlined herein or engages in behavior deemed unsafe or inappropriate by the charter company or vessel owner.

  • Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Texas, and any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Texas.

Refund Policy:

  • Cancellation by Client:

    • If the Client cancels the booking more than 10 days prior to the scheduled sailing instruction session or charter period, a full refund of any fees paid will be issued, minus any non-refundable deposit specified in the agreement, does not apply to Sailing Retreats.
    • If the Client cancels the booking less than 45 days prior to the scheduled Instructional Sailing Retreat, no refund will be issued unless a replacement can be found, otherwise any fees paid will be forfeited.
    • Any requests for cancellations must be submitted in writing to Sails & Grace, and the date of receipt of the cancellation request will determine the applicable refund policy.
  • Cancellation by Instructor or Instructional Sailing Retreat:

    • In the event that the Instructor or sailing retreat cancels the session/event due to unforeseen circumstances, such as inclement weather, vessel unavailability, or instructor unavailability, the Client will be offered the option to reschedule the session or receive a full refund of any fees paid.
    • The Instructor or Instructional Sailing Retreat event reserves the right to cancel or reschedule sessions or charters at their discretion, and every effort will be made to provide advance notice to the Client in such cases.
  • Refunds for Partially Completed Charters or Sessions:

    • No refunds will be issued for sailing instruction sessions or sailing retreats that are partially completed by the Client, regardless of the reason for early termination.
    • Clients are responsible for the full cost of the session or charter period, regardless of the actual duration of use.
  • Refund Processing:

    • Refunds will be processed within 10 business days of receipt of the cancellation request, using the same payment method used for the original booking.
    • Any applicable refund processing fees or bank charges will be deducted from the refund amount.
  • Force Majeure:

    • In cases of force majeure events, such as natural disasters, acts of terrorism, or government regulations, the refund policy may be subject to change at the discretion of the Instructor or Sails & Grace.
  • Exceptions:

    • Exceptions to the refund policy may be granted in extenuating circumstances, subject to approval by the Instructor or Sails & Grace.
    • Any requests for exceptions must be submitted in writing and will be considered on a case-by-case basis.

    • For inquiries or assistance regarding refunds, Clients may contact the Instructor or Sails & Grace directly using the contact information provided in the booking confirmation or agreement.
