Sails & Grace Terms & Conditions

These Terms & Conditions ("Terms") govern participation in all sailing instruction, coaching, assessments, clinics, charters, mentoring programs, events, and destination sailing experiences offered by Sails & Grace ("Sails & Grace," "Company," "we," "our," or "us"). By registering for, booking, attending, or making payment toward any service, program, or trip, you ("Participant" or "Client") acknowledge that you have read, understood, and agree to these Terms.

1. Assumption of Risk

Sailing and boating activities involve inherent risks that cannot be eliminated regardless of the level of supervision, instruction, or preparation provided. These risks may include, but are not limited to, changing weather conditions, vessel movement, equipment failure, slips and falls, exposure to sun and water, injury, illness, property damage, and other hazards associated with being on or around the water.

By participating in any Sails & Grace activity, you voluntarily assume all risks associated with participation and agree to follow all instructions provided by instructors, captains, crew members, and representatives of Sails & Grace.

2. Participant Responsibilities

Participants are responsible for:

  • Providing accurate registration, emergency contact, and travel information.
  • Disclosing any relevant medical conditions, allergies, medications, dietary restrictions, mobility limitations, or other circumstances that may affect participation.
  • Following all safety procedures and vessel rules.
  • Arriving on time and prepared for scheduled activities.
  • Maintaining respectful and professional behavior toward instructors, crew, suppliers, and fellow participants.

Sails & Grace reserves the right to refuse participation or remove any participant whose behavior is unsafe, disruptive, abusive, illegal, intoxicated, or otherwise detrimental to the safety or enjoyment of others. No refund will be provided in such circumstances.

3. Payments

Payment schedules, deposits, installment plans, and due dates will be communicated during registration, booking, or invoicing.

Unless otherwise stated in writing:

  • Deposits are non-refundable.
  • Reservations are not confirmed until required payments have been received.
  • Failure to make payments by the stated due dates may result in cancellation of the reservation.
  • Outstanding balances must be paid in full before participation begins.

By submitting payment, the Client authorizes Sails & Grace to process charges according to the agreed payment schedule and acknowledges acceptance of these Terms & Conditions.

4. Cancellation by Participant

All cancellation requests must be submitted in writing.

Local Instruction, Coaching, Assessments, and Clinics

For local instruction, private coaching sessions, assessments, mentoring programs, and clinics:

  • Cancellations made more than fourteen (14) days before the scheduled activity may receive a credit toward future services.
  • Cancellations made within fourteen (14) days of the scheduled activity are generally non-refundable.
  • No-shows are not eligible for refunds or credits.

Destination Programs and Sailing Trips

Destination trips require significant advance planning, charter commitments, instructor scheduling, and supplier payments.

Unless otherwise stated in a trip-specific agreement:

  • Deposits are non-refundable.
  • Payments become non-refundable once committed to charter companies, accommodations, instructors, suppliers, or other trip-related expenses.
  • No refunds will be provided for missed flights, travel delays, illness, personal emergencies, failure to obtain required travel documents, or voluntary early departure from a trip.

Participant Replacement Option

If a participant is unable to attend a destination program or sailing trip, they should notify Sails & Grace as soon as possible.

Participants may identify a suitable replacement participant, subject to approval by Sails & Grace and any applicable charter company, certification organization, supplier, or program requirements.

If Sails & Grace is able to secure a replacement participant for the canceled reservation, the original participant will receive a refund of amounts paid, less a $250 administrative fee and any costs incurred to facilitate the replacement.

If the replacement reservation is sold at a discounted rate, the difference between the original reservation amount and the replacement sale amount will not be refunded. The original participant's refund will be reduced by the amount of the discount.

For example, if the original reservation was $4,800 and the replacement reservation is sold for $4,300, the original participant would be responsible for the $500 difference, in addition to the $250 administrative fee.

Sails & Grace reserves the sole right to determine pricing, promotional offers, incentives, and discounts necessary to fill a canceled reservation.

Sails & Grace cannot guarantee that a replacement participant will be found. If a replacement cannot be secured, standard cancellation terms will apply.

5. Cancellation, Rescheduling, or Modification by Sails & Grace

Sails & Grace reserves the right to cancel, postpone, reschedule, relocate, or modify any activity, program, instructor assignment, vessel, destination, or itinerary due to:

  • Weather conditions
  • Safety concerns
  • Mechanical issues
  • Insufficient enrollment
  • Instructor availability
  • Government restrictions
  • Supplier changes
  • Force majeure events
  • Other circumstances beyond our reasonable control

When possible, participants may be offered a refund, credit, transfer, or rescheduling option at the sole discretion of Sails & Grace.

Sails & Grace is not responsible for incidental or consequential expenses incurred by participants, including but not limited to airfare, accommodations, transportation, meals, lost wages, travel costs, or other personal expenses.

6. Weather, Vessel, and Itinerary Changes

Sailing activities are weather dependent and subject to operational realities.

For safety, instructional, operational, or weather-related reasons, Sails & Grace may modify:

  • Routes
  • Destinations
  • Anchorages
  • Marinas
  • Daily schedules
  • Activities
  • Vessels
  • Instructional objectives

All decisions regarding itinerary and vessel operations will be made with participant safety as the primary consideration.

Such changes do not constitute grounds for refunds, credits, compensation, or chargebacks.

7. Travel Insurance

Sails & Grace strongly recommends that all participants purchase comprehensive travel insurance, particularly for destination programs and multi-day trips.

Coverage should ideally include:

  • Trip cancellation
  • Trip interruption
  • Emergency medical expenses
  • Medical evacuation
  • Travel delays
  • Lost or delayed baggage

Participants are solely responsible for obtaining and understanding their insurance coverage.

Sails & Grace is not responsible for losses resulting from weather, illness, injury, transportation delays, government actions, supplier cancellations, force majeure events, or other circumstances beyond our control.

8. Third-Party Suppliers

Sails & Grace may coordinate or utilize services provided by independent third parties, including but not limited to:

  • Charter companies
  • Marinas
  • Airlines
  • Transportation providers
  • Hotels
  • Restaurants
  • Tour operators
  • Certification organizations

These suppliers operate independently and are not agents, employees, or representatives of Sails & Grace.

Sails & Grace is not responsible for the acts, omissions, negligence, delays, interruptions, cancellations, bankruptcy, or failures of any third-party supplier.

9. Certifications, Assessments, and Educational Programs

Participation in instruction, coaching, mentoring, assessments, preparation programs, or educational experiences does not guarantee certification, licensing, ranking, endorsement, assessment approval, or qualification.

Participants remain responsible for satisfying all requirements established by any applicable certification authority or training organization.

Assessment and certification outcomes are determined by the evaluating instructor or certifying organization based on demonstrated competency and applicable standards.

10. Photography and Media Release

Unless a participant notifies Sails & Grace in writing before the start of the activity, participants grant Sails & Grace permission to use photographs, videos, testimonials, audio recordings, and other media captured during participation for educational, promotional, marketing, website, social media, and business purposes.

Participants may request exclusion from promotional materials by providing written notice prior to the activity.

11. Limitation of Liability

To the fullest extent permitted by law, Sails & Grace, its owners, instructors, captains, employees, contractors, agents, and representatives shall not be liable for any personal injury, illness, death, property damage, lost or stolen belongings, travel interruptions, financial losses, or consequential damages arising from participation in any activity, except where such limitation is prohibited by law.

12. Chargebacks and Payment Disputes

By submitting payment, the Client acknowledges receipt of these Terms and agrees that purchased services, reservations, deposits, installments, and instructional programs are subject to the cancellation and refund policies described herein.

The Client agrees to contact Sails & Grace directly regarding any billing concerns before initiating a chargeback or payment dispute.

Documentation including invoices, registration forms, waivers, payment records, email communications, booking confirmations, and acceptance of these Terms may be used to respond to payment disputes and chargebacks.

13. Force Majeure

Sails & Grace shall not be liable for delays, interruptions, modifications, or cancellations caused by circumstances beyond our reasonable control, including but not limited to:

  • Hurricanes
  • Severe weather
  • Natural disasters
  • Fire
  • Pandemics
  • Government actions
  • Labor disputes
  • Transportation interruptions
  • Civil unrest
  • War
  • Utility failures
  • Acts of God

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Any dispute arising from these Terms or participation in a Sails & Grace program shall be brought exclusively in a court of competent jurisdiction located within the State of Texas.

15. Acceptance of Terms

By registering, booking, making payment, signing a waiver, participating in an activity, or otherwise engaging with services provided by Sails & Grace, the Participant acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions.
